Building your defense

10 critical verification points

Mark the status of each point according to the employee's actual situation. Points that trigger a statutory protection ("fuero") or reinforced job stability weigh more heavily in the risk calculation, because overlooking them often leads to reinstatement orders.

Required documentation checklist for termination

Confirm that you have the supporting documents required by the Colombian Labor Code (CST) to formalize the termination and avoid the late-payment penalty.

0/10 documents verified

Mandatory documentation

Required by law for any type of termination, regardless of the grounds.

Optional or conditional documentation

Depends on the company's internal policies, prior agreements, or the specific circumstances of the termination.

Recommendations for the employer

  1. Every termination process must be documented in writing and signed off as received by the employee.
  2. If the employee refuses to sign the termination notice, do it in front of two witnesses who can sign a record stating the fact.
  3. Payment of the final settlement must not be delayed while waiting for the "clearance" ("Paz y Salvo") signature. If there are outstanding debts, they may only be deducted from the settlement with express, prior, written authorization from the employee.

Complete the required fields and assess all 10 points to enable the report.
